PRIVACY POLICY (INCLUDING COOKIE POLICY)

1. Introduction and Scope

KS Associates, Inc. (“Company,” “we,” “us,” or “our”) respects the privacy of visitors to our website located at https://ksassociates.com/ (the “Site”).  This Privacy Policy describes the personal information we collect through the Site, how we use and disclose it, and the choices available to you.  This Policy also serves as our Cookie Policy and describes the cookies and similar tracking technologies used on the Site, including in the table at Section 3.

This Policy applies only to information collected through the Site.  It does not govern information the Company collects in connection with the professional services it provides to clients, or through offline interactions, which are addressed under separate engagement terms and confidentiality obligations.

2. Information We Collect

Information You Provide Directly.  When you submit an inquiry through the contact form on the Site, we collect the information you choose to provide, which may include your name, email address, phone number, company name, and the content of your message.

Information Collected Automatically.  When you visit the Site, Google Analytics automatically collects certain technical information on our behalf, including IP address (truncated/anonymized consistent with Google’s current default configuration), browser and device type, operating system, pages viewed, time on page, referring URL, and general geographic location derived from IP address.  See Section 3.

We do not intentionally collect Social Security numbers, financial account information, health information, or precise geolocation data through the Site, and we ask that you not include such information in the contact form.

3. Cookies and Similar Tracking Technologies

The Site uses cookies and similar technologies to operate correctly and to help us understand how visitors use the Site.  The table below describes the cookies currently used on the Site.  This table describes cookies and tracking technologies used on the Site itself; it does not cover the third-party job application portal described in Section 8, which operates independently and is not subject to the representations in this Section. 

No Advertising or Behavioral-Tracking Cookies.  The Site does not use, and the Company does not permit, cookies or similar technologies for cross-context behavioral advertising, retargeting, or the sale of personal information.  Google Analytics is used solely for first-party, aggregate site-usage analytics.  This representation applies to the Site itself and does not extend to the third-party job application portal described in Section 8.

Managing Cookies.  On your first visit, a banner will notify you that the Site uses cookies and link to this Policy.  Clicking “Accept” (or continuing to browse, per the banner’s terms) reflects your acknowledgment of this Policy.  You may also control or delete cookies at any time through your browser settings — note that disabling cookies may affect Site functionality — and you may opt out of Google Analytics generally by installing the Google Analytics Opt-out Browser Add-on (available at tools.google.com/dlpage/gaoptout).

4. How We Use Information

• To respond to inquiries submitted through the contact form
• To operate, maintain, secure, and improve the Site
• To understand aggregate Site usage and performance trends
• To detect, investigate, and address technical issues, fraud, or misuse
• To comply with applicable legal obligations

We do not use information collected through the Site for automated decision-making that produces legal or similarly significant effects on you, and we do not sell personal information or share it for cross-context behavioral advertising.

5. Disclosure of Information

We may disclose information collected through the Site to:

• Service providers who process information on our behalf for the purposes described above, including Google (Google Analytics) and our website hosting/development provider, each of which is restricted from using the information for its own independent purposes
• Government authorities or other third parties as required by law, regulation, subpoena, or other legal process
• A successor entity in connection with a merger, acquisition, financing, or sale of assets

The Company does not sell personal information to third parties.

6. Data Retention

We retain contact form submissions for as long as reasonably necessary to respond to the inquiry and for internal recordkeeping purposes, generally not to exceed 24 months, unless a longer period is required by law or necessary to establish, exercise, or defend legal claims.  Google Analytics data is retained according to the retention setting configured in the Company’s GA4 property (Google’s maximum configurable retention is 14 months for user-level and event-level data); the Company’s web developer or marketing vendor should confirm this setting at launch and align it with the period stated here.

7. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect information submitted through the Site against unauthorized access, use, or disclosure.  No method of internet transmission or electronic storage is completely secure, and the Company cannot guarantee absolute security.

8. Third-Party Links and Job Applications

The Site contains a link to a third-party job application portal, currently hosted by ApplicantPool (applicantpool.com), which may embed a Refer.io referral-tracking widget and other third-party scripts, cookies, or tracking technologies.  That portal, and any successor or similar platform the Company may use for job applications, is operated independently of the Site and is not covered by this Policy, including the cookie table in Section 3 or the representations in that Section regarding tracking technologies.

The Company does not control, and does not assume responsibility for, the privacy practices, security, or data handling of that portal or any tools it embeds.  If you apply for a position through that portal, your information will be subject to ApplicantPool’s and Refer.io’s own privacy policies and terms of use, not this Policy, and we encourage you to review those documents before submitting an application.  ApplicantPool, Refer.io, and any similar third-party platform are independent service providers and are not agents of the Company.

9. Children’s Privacy

The Site is directed to businesses and professional visitors, not to children, and is not intended for use by individuals under the age of 13.  We do not knowingly collect personal information from children under 13 through the Site.  If we become aware that we have inadvertently done so, we will take reasonable steps to delete that information.

10. State Privacy Law Notice

The Company is based in Ohio, and its business, marketing, and client relationships are concentrated in Ohio, with limited additional work performed in Michigan, Kentucky, Pennsylvania, and Massachusetts.  The Company does not direct the Site or its services to residents of California or any other state, and any incidental visits to the Site from other states are unsolicited.

As of the date of this Policy, the Company does not believe the Site’s data collection and traffic volume meet the applicability thresholds of any comprehensive U.S. state consumer privacy law.  This includes the Kentucky Consumer Data Protection Act (effective January 1, 2026), which applies only to entities that control or process the personal data of 100,000 or more Kentucky consumers annually, or 25,000 or more Kentucky consumers where the entity derives more than 50% of gross revenue from the sale of personal data — thresholds well beyond the Site’s expected traffic.  Michigan and Pennsylvania do not currently have a comprehensive consumer privacy statute in effect.  This assessment should be revisited if the Site’s traffic, data practices, or the Company’s multistate footprint materially change, or if pending legislation in these states is enacted.

Notwithstanding the foregoing, if you have questions about information you have submitted to us or would like to request that we delete it, you may contact us using the information in Section 13, and we will respond as a matter of Company practice.

11. International Visitors

The Site is directed to visitors in the United States.  The Company does not offer goods or services to, and does not monitor the behavior of, individuals located in the European Union, the United Kingdom, or Canada, and does not target those jurisdictions in any respect. Any access to the Site from those jurisdictions is unsolicited and incidental.  Accordingly, the Company does not process personal information through the Site in a manner subject to the EU General Data Protection Regulation, the UK GDPR, or Canadian federal or provincial privacy law.

12. Changes to This Policy

We may update this Policy from time to time.  The “Last Updated” date above reflects the date of the most recent revision.  Material changes will be reflected by posting the revised Policy on the Site.
